NRC South Report January 2012

The Forest Service released two important documents in January. The first is the long awaited Final Programmatic Environmental Impact Statement (PEIS) for the National Forest System Land Management Planning Rule.  The second is Forest Service Watershed Condition Framework.

After review of nearly 300,000 comments received on the proposed rule and draft environmental impact statement issued February 2011, Forest Service has released their preferred course of action for the national planning rule.  The Record of Decision on the final planning rule is expected within 30 day of February 3, the official release date.

The preferred alternative emphasizes collaboration and strengthens the role of public involvement and dialogue throughout the planning process. It also would require the use of the best available scientific information for decisions.

Recovery Implementation Team Members Set

The U.S. Fish and Wildlife Service has begun notifying individuals of acceptance as a team member for the Desert Tortoise Recovery Implementation Teams. The RIT consists of land managers, stakeholders, and scientists with an interest in Mojave desert tortoise recovery.

CA4WDC NRC South Monthly Report - Dec 2011

Recreation advocate article to appear in Law Book: I wrote an article in 2008 advocating recreation inclusion in public lands management policy that will be published in law book designed for classroom use in U.S. Law schools.  The article will appear in the Natural Resources Law 2nd Edition, authored by Jan Laitos, University of Denver Sturm College of Law.

It is an honor to have an article selected for publication in a law book.  I believe this represents the beginning of an era of change in litigation and management.

NRC South Report - November 2011

Legal Update: The Truckhaven lawsuit is moving with the final preliminary briefs being filed on Nov 4.  There is a pending Nov 30, 2011 evidentiary hearing scheduled.  State Parks is challenging that some of the documents submitted by recreation interests should not be admitted as part of the administrative record.  Opening briefs and counter briefs will be filed in late December and January.  As CEQA issues receive docket preference, a ruling is expected as early as April 2012.

Oceano Dunes SVRA - The long awaited air quality study for Oceano Dunes SVRA has been released and presented to the OHMVR Commission at an Oct 13-14 meeting in Grover Beach.  Part of the meeting included a tour of the dunes area and a review of the methodology used to develop the study and collect the data.  The Friends of Oceano Dunes commissioned an independent review of the study data which identified some issues with the study methodology and data collection.  The local community leadership showed strong support for the continued use of Oceano Dunes SVRA by motorized recreation.

NRC South Report - September 2011

The California Motorized Recreation Council (CAMRC) a non-profit association comprised of the leadership of the largest Off Highway Vehicle recreation organizations in California met with members of the 29 Palms Marines base expansion committee to engage in a status update regarding the draft Environmental Impact Study (EIS). The CAMRC invited a number of relevant organization that are not currently CAMRC members in an effort to reach the largest audience and provide a well rounded direction to discussions regarding the Marine Corps base expansion efforts. The CAMRC also hoped to ensure the public was well represented in the event that additional options to the current alternatives where introduced by the Marine Corps.
